Hank Hiiich presented a colored <br />nap to the Coanission which he received from the Hemepin Couity <br />^ Conservation District. They advised against building on the <br />blue area which contains soils not suit^le in maintaining <br />on>site septic systems. Additional information received <br />regarding proposed rerouting of Comty roadways revealed the <br />proposed road is plarrsd throo^ most of the remaining hi^, <br />buildable area of this plat. Ihe Zoning i^hiiinistrator <br />informed the Gonnission that the applicant is aware of these <br />reports and was very q»set after learning that tiiere might <br />be some difficulty developing this area because of the <br />existing conditions. Applicant felt he diould have the <br />ri^t to develop the area or some way be reishursed. The <br />Zoning Adninistrator suggested he contact Watershed, Flood- <br />plain or Conservation Agencies or the Hennepin Goiai^ Kigh- <br />y way Department. The City's primary objective through control <br />of land use is providing protection of health, safbty and <br />welfare of the public. <br />Hake moved, Pesek seconded, to table this matter. Motion - <br />Ayes (6), Na^ (0). <br />^ ne 1 Oand <br />Mr. Solie was present. The Zoning Adninistrator presented <br />the letter from the Minnehaha Creek Water^ed District <br />stating that they encourage the use of rode riprap for the <br />control of shoreline erosion. Mr. Solie again stated that <br />he had received the approval of the Pollution Control Agency <br />' the Minnehaha Creek Watershed District. After a brief <br />discussion. Hake moved, Pesek seconded, to recommend <br />approval for the request for a conditicnal use permit for <br />grading and filling on the basis that Mr. Solie was acting <br />on the approval of the MCMD and was not aware that he was <br />in violation of the Orono code. Motion - Ayes (6), Nays <br />(0). <br />Hdoe also moved, Pesek seconded, that the Village immediately <br />notify the Department of Natural Resources, Pollution Control <br />Agency, UCD and the Watershed District concerning their <br />Mocedures for approval of applications such as this. <br />Planning Coandssion felt that fijture approvals should be based <br />on the stipulation that Orono review applications before final <br />approval is granted, or that any projects involving Orono be <br />referred to us for approval.
