m * <br />MIWTES of a planning GCM^SSION meeting held JANUARY 5, 1976 • PAGE 2 <br />Jeter Fox of Frederick ^rfurth Realty, Mr. Roger's agent, about <br />^pe situation and advised them that the variance proposal would <br />oe deferred until six* time that the conditions were corrected. <br />The Coninission directed that a copy of the Becker letter be siib- <br />mitted to the City Council. Hake moved, Pesek seconded, that <br />^fr. Fox be informed that because of the applicant's lack of <br />representation and because the hazardous conditions at the pro <br />perty site had not been corrected the petition be tabled. <br />Motion, Ayes (6) - Nays (0). <br />H^e moved, Pesek seconded, that the variance application of <br />Vincent Johnson be tabled due to lack of representation at <br />the meeting. Motion, Ayes (6) - Nays (0). <br />WU <br />Q: <br />Jerry's Construction Conpany, representing Odd Rovick, pre <br />sented a fill and drainage plan for the property at 1055 Fem- <br />dale Road West. The plan included svredes in the front yard <br />area to divert drainage away from the lake. A retaining wall <br />in the back lot area was included, for the purpose of diverting <br />drainage across the road, into a natural poking area on the <br />other side of the street, instead of it flowing into the ad <br />jacent low area of a nei^iboring property. The men stated that <br />35 truck loads of fill would be needra on the vhole site of <br />i*ich 5 tiudc loads would be needed within the 75 ft. lake- <br />ore setback in order to mate a 25 ft. taper from the house. <br />ey also noted that there used to be five cabins at the site <br />and \dien they were taken down the natural drainage was des <br />troyed. The Coninission felt that the retaining wall could <br />be the means of blodcing a natural ponding area. McDonald <br />moved, Woolley seconded, that the Planning Coninission recom <br />mend to the Council approval of the fill and drainage plan <br />of Odd Rovick with the following stipulations: (1) That the <br />plan allow only the noxmal fill and grading requir^ for the <br />house plan previously presented to the City. (2) Only <br />natural fill materials be allowed in the house construction. <br />(3) That the City Engineer approve the plan (4) That the <br />retsdning wall be taken out of the plan and the area left <br />in it's natural state.if the Engineer deemed this necessary. <br />Motion, Ayes (6) - Nays (0). <br />IXnlap moved, Pesek seconded, tiiat the variance application of <br />Doug Heinsch be tabled due to lack of representation and asked <br />that the applicant qipear at a forthcoming meeting to discuss <br />the reason for the variance and the consideration of possible <br />alternatives that would comply with City codes. Motion, Ayes <br />(6) - Nays (0). <br />The Planning Coninission directed that a Public Hearing be held <br />Februaiy 2, 1976, at 7:30 P.M. in the Orono City Hall on the <br />Hildur P.
