is fenced. <br />If the Council desires to include pools in the regulations as <br />accessory structures which count against "lot coverage by <br />buildings* regardless of the fence height, an aaendment of the <br />accessory structure ordinance could be referred to the Planning <br />Commission for initiation of the process. <br />Under both the previous and present ordinance a pool of limited <br />size can be constructed on any size property provided the <br />required normal or oversized accessory structure setbacks are <br />met. <br />ALTERNATIVES <br />1. Accept the information. <br />2. Direct that an ordinance amendment be drafted. <br />3. Table for further discussion. <br />RECOMMENDATION - It is recommended that the Council request staff <br />to proceed with an ordinance amendment regulating pools as a <br />building type accessory structure, but leaving tennis courts, <br />paddocks and arenas as excluded items when they have walls or <br />fences no greater than six feet in height. Patios and decks <br />would still be treated as structures requiring setbacks or non <br />encroachments, based on their height above grade. <br />PROPOSED MOTION - Moved by _, seconded by _, that the Council <br />having accepted the information direct staff to prepare an <br />ordinance amendment for Planning Commission consideration for <br />inclusion of pools in the calculation of percentage lot coverage <br />by buildings for a given property.
