G. Fences. Fences erected in all zoning districts are considered as a non- <br />gneroaghmgnt when they conform to the foll9%.\.-ing <br />I Non-Lakeshore Lots: <br />a. Fences and u’alls within a required front yard or side street yard shall net <br />exceed a height of 42 inches above original yrade. <br />b. Fences and walls within a required rear or side vard shall not exceed a <br />height of 6 fcc( above original grade. <br />2. Lakeshore Lots: <br />a. Fences within the required street frear) yard or side street yard of a <br />lakeshore lot shall not exceed 42 inches above original grade. Exception: A fence not exceeding 6 <br />feet in height mav be located alone the street lot line of a lake frontage lot which abuts a major <br />thoroughfare. A maior thoroughfare forpuroosesof this ordinance means anv Hennepin Countv road <br />or State highway. If such fence involves fill or berming. the total combined height of both fence and <br />fill shall not exceed 6 feet above the height of the crovsn of the maior thoroughfare. <br />b. Fences within the required side vard of a lakeshore lot shall not exceed 6 <br />feet in height, and anv portion located lakeward of the "‘average lakcsiiore fence setback line” shall <br />not exceed 42 inches in height. The “average lakeshore fence setback line” is a line draxsii between <br />the most lakeward projection of the fence owner’s principal residence structure and the most <br />lakeward projection of the adjacent affected principal residence structure. <br />c. Fences shall not be constructed within the defined lakeshore yard of a <br />lakeshore lot, i.e. shall not be located within 75 feet of the shoreline for General Development Lakes. <br />100 feet for Recreational Lakes, or 1 50 feet for Natural Fnvironment Lakes. <br />3. Special Provisions: Split rail fences of no more than 3 rails within a required <br />front, street or side street yard mav have a maximum top rail height of 48 inches above original <br />grade. Intersection Sightline Obstruction Prohibited. No fence shall be installed so as to <br />obstruct a required clear view at street intersections as required bv Section 10.03. Subd. 16 of the <br />Municipal Code. <br />5. Fence Construction and Maintenance. <br />a The ouner of a fence shall maintain it in a condition of reasonable repair <br />and appearance and shall niM allow it to become or remain in disrepair of in a danyerous condition. <br />b. Fences shall be installed with the finished side facing neighboring <br />properties or the street (finished side is that side having no visible structural supports!.
