3. <br />Any amendments to the individual site and building plans shall require Building <br />and Zoning Department SlafT approval. Staff findings shall be made that the <br />final site and building plans arc consistent uith the approved plans. Ihc <br />Building and Zoning Staff shiil refer any plans to the City Council that arc <br />found to not be consistent 'vith the variance approvals. <br />Authorities granted by th.s variance run wth the property not with the <br />applicants, but arc permissive only and must be exercised by application for a <br />building permit within one >-ear of the date of Council approval, or this variance <br />will expire on that date (November 13. 2002). <br />Violation of or non*compliance with any of the terms and conditions of this <br />variance shall constitute a violation of the zoning code, siiall automatically <br />terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />1 he undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heirs, successors and <br />assigns, hereby agrees to the recording of this resolution in the Chain of Title <br />of the property. <br />Page 6 of9
