A. <br />D. <br />The property has been developed with a rcsideniial use since at least 1920. <br />The site plan indicates the proposed residence. It meets all requirements for <br />sethaAs. hardcover and structural lot coverage. <br />C. <br />D. <br />K. <br />The lot can be developed without the need for further variances. <br />The detached accessory' buildings arc in good structural condition <br />Variance approval was granted for the detached garage in 1997 and a permit <br />was issued for the shed in 1999. <br />I'hc City Council finds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variances will not adversely atTect traiTic conditions, light, air. nor pose a fire <br />hazard or other danger to neighboring property; would nut merely serve os a <br />convenience to the applicant, but is necessary to alle\ late a demonstrable hardship <br />or dilTicuIty; is necessary to preserve a substantial property right of the applicant; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicant and the effect of the proposed variances on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council heieby ^'rants <br />variances to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to allow new residential <br />construction on a lot that is 100 feet wide and 140 feet is required aiKl Section 10.03.
