r <br />G. Fences. Fences erected in all zoning districts are considered as a non- <br />encroachment when they conform to the follouinp jUflpdarHs* <br />I ■ Non»Lakeshore Lots: <br />a. Fences and walls within a required front yard or side street yard shall not <br />exceed a height of 42 inches above original yradg. <br />b. Fences and walls within a required rear or side yard shall not exceed n <br />height of 6 feet above original grade. <br />? Ijikeahore l.Qls: <br />a. Fences within the required street frear^ yard or side street N'ard of a <br />lakeshore lot shall not exceed 42 inches above original grade. Exception: A fence not exceeding 6 <br />feet in height mav be located along the street lot line of a lake frontage lot which abuts a major <br />jthoroughfafc. A major thoromjthfare for purposes of this ordinance means anv Hennepin Countv road <br />or State highway. If such fence involves fill or berminy. the total combined height of Doth fence and <br />fill shall not exceed 6 feet above the height of the crowTi of the major thoroughfare. <br />b. Fences within the required side \*ard of a lakeshore lot shall not exceed 6 <br />feet in height, and anv portion located lakevN'ard of the **average lakeshore fence setback line” shall <br />not exceed 42 inches in height. The “average lakeshore fence setback line” is a line drawn between <br />the most lakcward projection of the fence ouncr’s principal residence structure and the most <br />lakevvard projection of the adjacent affected principal residence structure. <br />c. Fences shall not be constructed within the defined lakeshore yard of a <br />lakeshore lot, i.e. shall not be located within 75 feet of the shoreline for General Development Lakes. <br />100 feet for Recreational Lakes, or 1 50 feet for Natural Environment I <br />3. Special Provisions: Split rail fences of no more than 3 rails within a required <br />front street or side street yard mav have a maximum too rail height of 48 inches abo\'e original <br />grade. Board rail fences within a front, street or side street yard for the specific Dumosc of enclosing <br />howeamaN- have a top rail height of 60‘* and shall be no more than 50*/o opaque.JioweamaN- have a top rail tieignt ot t>u and <br />.Ml i U A ^ <br />4. Intersection Sightline Obstruction Prohibited. No fence shall be installed so as to <br />obstruct a required clear view at street intersections as required bv Section 10 03. Subd. 16 of the <br />Municipal Code. <br />5. Fence Construction and Maintenance. <br />a. The ouner of a fence shall maintain it in a condition of reasonable repair <br />and appearance and shall not allow it to become or remain in disrepair of in a dangerous condition. <br />b, Fences shall be installed vith the finished side facin^ neighboring <br />properties or the street (finished side is that side having no visible structural supports!. <br />1 <br />I
