A RESOLUTION VACATING A PORTION OF <br />AN UNIMPROVED STREET WITHIN THE <br />PLAT OF BAYSIDE ADDITION TO LAKE MINNETONKA, <br />HENNEPIN COUNTY. MINNESOTA <br />FILE NO. DI-2707 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on September 22. 2001 Robert A. Eddington and Mark R. Larsoi. <br />(hereinafter "the applicants") filed a petition with the City of Orono requesting the vacation of <br />a portion of on unimproved public right-of-w-ay originally dedicated in the plat of Baysidc <br />Addition to Lake Minnetonka, Hennepin County. Minnesota lying between Lot 8 Block 2 and <br />Lot I Block 5 thereof, and legally described as follows: <br />'fhat part of Hill Street which lies betv^een the northerly extensions of the cost <br />and west lines of Lot 1, Block 5. “Bayside Addition to Lake Minnetonka", <br />Hennepin County. Minnesota: and <br />WHEREAS, after due published and posted notice, a public hearing was held <br />b> Uie City's Planning Commission on October 15. 2001 regarding said vacation and all <br />interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, tlie Planning Commission <br />recommended unanimous approval of the proposed vacation; and <br />WHEREAS, the City Council of the City of Orono finds that said \acation as <br />proposed is in keeping with the public interest and in cou.sideration of the following findings; <br />1. The unimproved right-of-way contains no municipal sewer or other utilities. <br />2. The 40 foot right-of-way has never been developed as a public street. <br />3. The unimproved 40 foot right of way has been found to ser\e no future public purpose. <br />Page I of 4
