1. <br />2. <br />FINDINGS <br />This application \kos reviewed as Zoning File #01-2717, <br />This property is located in the LR-IB Zoning District, where I acre or 43.560 s.f. is <br />the minimum lot area. Th. property consists of approximately .66 acres or 28.577 <br />s.f. <br />1 he Orono Planning Commission reviewed this application on September 17,2001 <br />and recommended approval by a vote of 7 to 0. <br />The Planning Commission made the following findings of fact: <br />A.The propertN presiously contained an existing deteriorating retaining wall <br />system at Uie lai.eshore. Replacement of tlie retaining wall system was <br />necessary to pre\eiu erosion of the steep lakeshore yard. <br />The existing rock retaining walls are located w ithin 70* of the shoreline but <br />do not extend the full width of the properly. <br />C. <br />D. <br />The rock retaining wall system and steps haidcover is approximately 6.6®'o. <br />The applicants have agreed to provide a suitable planting and vegetation plan <br />which will providL adequate screening to the new retaining wall. <br />No additional hardcover should be allowed in the 0-75' setback area. <br />The City Council finds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variances would not adversely affect tralTic conditions, light, air. nor pose a fire <br />hazard or other danger to neighboring property; would not merely serxe os a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or diiTiculty; is necessary to preserx e a substantial property right of the applicants; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />Page 2 of 7 <br />juAL
