Therefore* horses are not permitted to graze \sithin I SO’ of <br />the OH WL of French Lake, as proposed. <br />The applicant has stated that he has a grazing plan from the Hennepin Conser\'ation Distiiwt <br />uliich they intend to follow. At a minimum, the Hennepin Conservation District has suggested <br />that a 15* buffer should be maintained between the horses and the edge of the wetland. <br />The island is surrounded by wetland which, further out, becomes open water and the delineated <br />edge of French Lake. It is possible to consider that the island is surrounded by wetland, not <br />lakeshore, requiring a 26 ’ setback instead of 150 ’. <br />Fences within 150'of the OHiVL <br />The applicant is requesting a fence to keep horses on the island. The fence would be a low <br />visibility fence that would not negatively impact existing wildlife. <br />Fences are not permitted within the defined lakeshore yard of a lakeshore lot. For this property, <br />the lakeshore lot b defined as ISO’ from the OHWL of French Lake. Therefore, fencing is not <br />permitted around the bland, as proposed. However, if the lake b considered to be wetland <br />surrounding the island as suggested above, the setback would be 26 ’. <br />Other CoBUMcats: <br />City Engineer <br />The City Engineer reviewed the application when it was first heard in February. He stated that a <br />typical section of the proposed roadway should be Included for review and erosion control <br />measures should be installed, inspected and approved prior to construction activity. Since this <br />time, a wetland delineation report has been received and a typical section of the proposed <br />roadwtiy has been submitted. Due to the lateness of the submission, the City Engineer has not <br />reviewed this information. City Engineer review and approval will be required prior to issuance <br />of permits. <br />Minnehaha Creek Watershed District <br />Wri:ten comments have been received from the Minnehaha Creek Watershed District regarding <br />this application. Formal review of the application for granting of pcmiits w ill be required. <br />Department of Natural Resources <br />The DNR surveyed the applicant’s property and determined that the pathway is above the OHWL <br />of French Lake and, therefore, docs not require DNR review nor approval. <br />Public Comments <br />Prior to the February Planning Commission meeting, five letters of opposition to this proposal <br />were received (attached for your information).
