One Family Rural Residential District (2 acre minimum) <br />Lot Area: 2.0 acres (87,120 s.f.) <br />Application Summary: Applicant requests a renewal variance to allow the existing <br />oversi2ed accessory structure to remain on the lot and for it to be relocated to a <br />conforming location in the rear of the lot. <br />Stqff Recommendation: Staff recommends denial of the request because the existing <br />conditions are not representative of the conditions that existed under the original variance <br />approx al <br />Perlincnl Zoning Ordinance Sections <br />Section 78-1432. l ime of Construction. No accessory building or structure shall be <br />constructed on any lot prior to the time of construction of the principal building to which <br />it is accessory. <br />Section 78-1434-3a. Area Restrictions. Any oversize accessory structure shall be subject <br />to the following conditions; No such accessory structure shall be located within a <br />required yard area (principal structure setbacks must be met). Further, no such suucture <br />shall be nearer the front lot line than the front line of the principal rc:>idence on the <br />property, and no such accessory structure shall be located less than 30 feet from the side <br />or rear lot line regardless whether less strict principal structure setbacks apply. <br />Section 78-1435.
