The property is on Forest Lake <br />Bay of Lake Minnetonka and is located in a cove where wave uid ice action will be minimal hence <br />the stability of such dock will be at minimal risk. <br />The dock is l^ated in Lake Minnetonka and is under the jurisdiction of the Ukc Minnetonka <br />^‘*y*^* (LMCD). The Ryskamp’s permit was approved by the LMCD in June, 2003. <br />The LMCD permit also granted a dock length variance for shallow water depth. The length of docks <br />IS generally held by the City to be under the primary jurisdiction of the LMCD, although the City has <br />ad^t^ by reference certain LMCD dock location regulations and the City does have concurrent <br />jurisdiction for certain lake uses under SecUon 10.55, Flood Plain and Wetlands Management. <br />Please review the LMCD memo and exhibiu of June 5,2003. <br />Staff Rf mawrndalion <br />St^recor^CT^ approval of the conditional use permit for replacement of a permanent dock <br />subject to the following conditions: <br />** continues to be permitted by the LMCD and <br />DNR and is in conformity with the rules and regulations of those agencies. <br />2.
