A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />SECTION 10.03, SUBDIVISION 9, <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.56, SUBDIVISION I6<L)(2) <br />FILE NO. 02-2760 <br />WHEREAS, James D. Cusack and Christine M Grace. (hereinaAer "the applicants'*) <br />arc the owners of the property located at 4140 Highwood Road within the City of Orono (hereinafter <br />"the City") and legally described as follows: <br />Lot 36, Highwood, Lake Minnetonka. Hennepin County, Minnesota, (hereinafter <br />•the propert)'”); and <br />WHEREAS, the applicants have applied to the City for xariances to Municipal <br />Zoning Code Section 10.24, Subdivision 5 (B) to permit a new single family residence on a lot of <br />.27 acre area and 51' width where I acre area and 140* width are normally required; Section 10.03, <br />Subdivision 9 to permit an accessory structure on a lot without a principal structure; and Section <br />10.22, Subdivision 2 and Section 10 56, Subdivision I6(L)(2) to allow 295.23 s.f.(94.9%)hardcover <br />in the 500-1000' setback area where 108.88 s.f. (35?o) is allowed. <br />WHEREAS, aAer due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on March 18,2002, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />FINDINGS <br />This application was reviewed as Zoning File #02-2760. <br />The property is located in the LR-IB Zoning District, where 43,560 s.f. or 1 acre is <br />the minimum required lot area.
