r <br />AnachmrmB <br />STORMWATER FAdUnr MAINTENANCE <br />Th«e tenra apply to the stormvuter facilities constmaed punuant to Minnehaha <br />Geek Watenhed Disukt pennit application number 02*058. <br />____ Applicant has applied for a perarit fromthe MCWD punuant to <br />MCWD Rule N, Stormwater Manag ement; and <br />WHEREAS, the property that is the $ub>ea of this agrecn*nt is legally described in <br />^ Declaration into uliich this Attachment is incorporated and the wri retention pond and <br />infiltration basin on the property to which these mai ntena nce requirements apply are described in <br />Attachment A - Erosion Control, Grading and Drainage Plan dated 10/23/02; <br />WHEREAS, MCWD Rule N provides that a maintenance agreement shall be <br />subnmed for stormwater treatment poi^, outlet structures for such ponds, cul\*erts, outfall <br />structures and all other stormwater facilities, tod that the maintenance agreement shaD specify <br />methods, schedule and responsible patties for maintenance and must include at a minimum, the <br />elements contained in the E^trkt’s Maintenance Agreement Form. <br />NOW, THEREFORE: <br />Applicant shall iiupert the stormwater retention and treatment basin(s) at a <br />minimum of once a )ear to determine if the basin's retention and treatment characteristics are <br />adequate. A storage treatment basin will be considered inadequate if sediment has decreased the wet <br />storage volume by Vi of hs original design s-ohime. Bas J on this inspection, if the stormwater <br />b.uin(s) is idenufied for sediment cleanout. Applicant shall restore the basic($) to iu original design <br />contours within one >ear of the inspection date. <br />2. Applicant shall iiupea the grit chambers, sump catch basins, smnp <br />manholes, outlet structures, culverts, outfall structures or other stormwater facilities for the project in <br />the spring and fall of each >ear. Applicant shall remove all sediment and debris during the <br />inspeoiom such that the stormwater facifities operate as designed and permitted. <br />3. ^olation of the inspection and/or maintenance provisions of this <br />Ag^ment is a viobtion of the MCWD permit for the project for wiuch the MCWD may take action <br />agaimi the Applicant. <br />dl^ir
