MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, No\‘cmb€r 20,2000 <br />ROLL <br />The Orono Planning Commission met on the above date with the following members present: <br />Chair Elizabeth Hawn, Commissioners Jay N>-gard, William Stoddard, Dale Lindquist, Janice <br />Berg, and Sandra Smith. Commissioner Daniel Kluth was absent. The following represented <br />City Staff. Senior Planning Coordnutor Michael Gaffron, Zoning Administrator Paul <br />Weinberger, Assistant Zoning Administrator Wendy Bottenbcrg, and Recorder Jackie Young. <br />City Council Representatives Gabriel Jabbour and Wchard Flint were present. <br />Chair Hawn called the meeting to order at 6:30 p.m. <br />PUBLIC HEARINGS <br />(«I) W2623 FRED JOHNSON, 1926 FAGERNESS POINT ROAD, VARIANCES, <br />6:31 p.m. - 6:<tS p.m. <br />Fred Johnson, Applicant, was present. <br />The Certificate of Mailing and Afiidavit of Publication were noted. <br />Weinberger slated the Applicants arc proposing to remove an existing residence and detached <br />garage and construct a new residence on a lot that is located entirely within the 75' lakeshorc <br />setback. Weinberger stated this is one of three lots that are all located on tlie south side of <br />Fagemess Road, with all three lots onlx having a depth of 70* from the lakeshorc. <br />Original]/ the Applicants had requested variances to lot w idth, lot area, lakeshorc setback ‘*nd <br />hardeev cr in order to construct a house consisting of 1,690 square feet After discussions vxith <br />Staff, the Applicants were advised to reduce the sire of the house to comply with the structural <br />coverage limitations. Weinberger noted for lots under 10,000 square feet, the property can have <br />a maximum of 1,500 square feet of structure <br />The Applicants have revised their plans and have redesigned the house to reduce the structural <br />coverage to 1,495 square feet, with the elimination of additional hardcover that would have been <br />required for a third stall to the garage Weinberger stated th.- amount of hardcover ilut exists on <br />the property currently is fairlv equal to What is being proposed <br />Weinberger stated since the property is located enti.civ within the 75‘ lakesliorc setback, it has <br />had variances granted in the past to allow replacement of structures in the 1980s Conditions <br />r!c;cd on the adjacent properties were that the amount of structure and hardcover not exceed <br />what had prev lously existed since no hardcover is normally permitted within 73* of the lakeshorc <br />Weinberger noted the existing house and deck are located only a few feel from the lakeshorc, <br />with removal of the house and construction of a new residence resulting in a setback averaging <br />30 feet to the house Relocating the house further from the street would not allow for an adequate <br />setback to the street, with 30 feet being the required setback to the street Weinberger noted the <br />Applicants are proposing a setback of :0 feet, which would allow sufficient space to back out cf <br />the garage into the driveway without backing a vehicle directly into the street and would provide <br />off street parking for the propertx . <br />PAGEl
