r: <br />Staff lIccoBiBMflMlalioas: <br />If Ihe Planning Commission feds that the applicant has shown undue hardship and should be <br />able to reconstruct a gravel dri\*eway by filling in and mitigating wetland to access land, <br />proposed to be enclosed with an electric fence and used for pasturing of horses from time to time, <br />then the variances and CUPs necessdfy should be approved, with the following conditions; <br />1. A wetland delineation report must be submitted to City staff prior to presentation of this <br />application at the City Council; <br />2. Review and i^iproval from Minnehaha Creek W^ershed District is required prior to City <br />permit approt^; <br />3. Review and approval from the Department of Natural Resources is required prior to City <br />permit approv'd; <br />4. City permit submittal must include a typical section of the proposed roadway and <br />illustrate that no grading will occur within S' of any lot line; <br />5. Erosion control measures should be installed, inspected and approved by the City prior to <br />any construction activity. <br />If the Plaiming Commission feels that there is no hardship to permit the constrviction of a <br />driveway through a wetland, and that the driveway reconstruction is not necessary to preserve the <br />owner’s rights, then the apr''cation for variances and CUPs should be denied. <br />M3-2869Dr Robert CumHU <br />i/n/iooi <br />Page 5 of 5
