RR-IU district. A minimum of two acres of open pasture must be available for a single <br />horse and one additional acre must be available for each additional horse. Wlten <br />permitted in the underlying zoning district, general cultivation, farming, grazing, <br />nurseries, horticulture, mick farming, and wild crop harvesting shall be allows in the <br />Shoreland Overlay District except that no such activity shall occur within the shore <br />setback zone. <br />Section 10.56. Subd. 7 (A) and Section 10.56. Subd. 16(C) (1): Shore setback: French <br />tjike is classified as a Natural Fnvironnicnt l.akc. requiring a setback of 150'. <br />Section 10.22. Subd. 2. Section 10.56. Subd. 16 (l.)(l) and Section 10.56. Subd 16 <br />(JH 3); Hardcover and driveways w ithin 75*: No hardcover or impervious surface shall <br />be placed. ItKated or constructed within 75 feet of the Ordinary High Water Level of any <br />lake or tributarv-. Drivewavs shall not be constructed within 75' of the Ordinary High <br />Water Level of public waters <br />Section 10.03. Subd. 15 (Ci)(2 c): Lakeshore lot fences: Fences shall not be constructed <br />within the defined lakeshore vard of a lakeshore lot. i.e. shall not be located vsiihin 150 <br />feet for Natural Fnvironment Lakes. <br />Application Summary ’: <br />The applicant ret]uests the following in order to n.*construet a 1.440 s.f. (1 20' x 12') gravel <br />driveway to access and use a 1 .X acre island on his property: <br />1 ) a variance for filling in 2.091 s.f. of a wetland, where no fill or hardcover is normally <br />permitted. <br />2) conditional use permits for movement of more than 500 cubic yards of fill and mitigating <br />wetland within the shoreland overlay district. <br />3) a variance to allow .in agricultural use (gra/ing ofhorses) within the 150' of the OllWL <br />of French I ake; <br />4) a variance to allow a 4* fence to be liKated as close as 14* from the OHWL of French <br />laikc where 150* is required, and <br />5) a variance for mitigating 4.234 s.f. of land within 75* of the OHWL of French l.akc where <br />no grading or excavation is permitted <br />There is an existing trail accessing the island of land at this time. The trail has been worn down <br />over time so the applicant wishes to improve it for machinery’ to be able to drive on it. In the <br />1950s. the original land owner used this land for grazing cattle. <br />The construction of the driveway requires 2.091 s.f of wetland to be filled with approximately <br />1 32 cubic yards of material if rebuilt on the existing drive. However, the amount of fill is <br />difficult to anticipate at this time so. since the s^>ils have not been checkcnl. there may be more <br />than 1 32 cubic yards of fill required.
