Smerling, I am writing <br />to inform you of the Smerlings* opposition to the grant of any <br />further permits or variances for the Holzer property. I also want <br />to take this opportunity to comment on Alan Olson's memorandum of <br />Noveniber 3, 1978 to the Planning Commission and Coimcil on this <br />subject. <br />Mr. Olson's description of the work that Mr. Holzer has <br />done thusfar on his property is substantially correct. A concrete <br />block retaining wall has been erected, without first obtaining any <br />permits or variances and in spite of the objections of neighboring <br />landowners. Furthermore, filling has been done to varioiis depths <br />over virtually the entire area of the lot, altering the natural <br />grade of land. Such filling is not only violative of the City's <br />ordinances in itself (§31.700), but it must also be taken into <br />account when considering the concrete blocK wall. The wall is <br />probably one foot or more taller'‘tif)an the dimensions given by <br />Mr. Olson if we measure from the natural grade instead of from <br />the new level which resulted from the filling done. <br />I would disagree with the characterization of the earlier <br />variance as being one for the construction of a new garage. It <br />was actually for the reconstruction of an old garage and may have <br />been violated, rendering it void. ^However, we do appreciate the <br />efforts of the City in requiring that the ^arage eaves be removed <br />and gutters be Installed, directing the rxm-off from the roof <br />onto the Holzer property. <br />^-- - - - - -^-
