After all the <br />public were heard, the Public Hearing was closed at 8:10 <br />p.m. <br />The Planning Commission continued to discuss this appli <br />cation. Pcsek moved, Hannah seconded, to table this matter <br />and suggested that the developer return with a more <br />acceptable plan indicating the following: <br />1. Elimination of the chanriel. <br />2. Conservation easements over marshlands and wetlands - <br />no filling of marshlands or wetlands. <br />3. Alternate provisions for docking - no outlots. <br />4. Lot line rearrangetuent of existing lot to corrply with <br />code requirements as our records indicate that this <br />parcel was not in single separate ow-nrrship as of <br />January 1, 1975. <br />5. Revised arrangement of lots, possibly eliminating one <br />or two lots. An area designated as marshlands by the <br />Hennepin County Soil Conservation District vdiich <br />extends across Lots 3, 5 and 6 is currently shown as <br />dry buildable land. <br />6. Indicate dry buildable lot areas in square footage. <br />7. Indicate easements (access and future utility). <br />Moticwi - Ayes (6), Nays (0). <br />Hosfield moved, Woolley seconded, that the minutes of the <br />December 6, 1976, meeting be approved. Motion - Ayes (6), <br />Nays (0). <br />Applicant was present along with adjoining property owners, <br />Hans Weiler and Richard Tiegen. The Zoning Administrator <br />stated that Mr. DeSplinter had just presented a new pro <br />posal before the meeting. The revised plan consisted of a <br />narrower and longer house with a garage located toward the <br />street and a lower level living area attached on the south <br />side of the house. A variance for lot width and area would <br />be required for this revised plan. A variance from the <br />right of way setback requirement would also be necessary, <br />ktr. Weiler approved of this revised plan. However, he was <br />concerned that this proposal could possibly block his view <br />of the lake. The applicant informed Mr. Weiler tJiat there <br />would be no obstruction of his view of the lake. Mr. <br />Weiler wanted^Jc be assured:that should Mr. DeSplintep sell <br />his property in the future, the netv- owner would not obstruct <br />his view with a proposed addition or fence. He felt that <br />any obstruction would take away from the value of his <br />property. Mr. Weiler stated that at the time he submitted <br />his proposal to build a residence, he was informed by the <br />Planning Commission that the subject lots were not build <br />able. Had he known that the subject lots were buildable, <br />he would have built up his house.
