I INFORMATION - COUNCIL AGENDA 10-23-78 <br />RESOLUTION NO. <br />A RESOLUTION REGARDING ENFORCEMENT OF ORDINANCE 210, <br />THE CITY OF ORONO ON-SITE SEWAGE TREATMENT CODE <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />zoning regulations, subdivision regulations and on-site sewage <br />treatment regulations for the orderly, economic and safe development <br />of land within the City and for pro .• of the public health and <br />safety by prevention of sewage poll •. -i of ground or surface waters; <br />and <br />WHEREAS, as a part of these regulations. Chapter 22.20, <br />Subdivision 6 of Ordinance 210, states that "No subdivision, lot <br />division or replattlng for the purpose of creating a new building <br />site, which property Includes the use of on-site systems, shall be <br />approved by the City until a site evaluation report as required by <br />the Design Manual has been reviewed and approved by the City engineer, <br />and all existing systems have been inspected and certified by the <br />City as being in compliance with this code."; and <br />WHEREAS, the intention of the above Section is to assure <br />that all newly created building sites will contain soil and site <br />characteristics suitable for proper operation of on-site sewage <br />treatment systems; and <br />WHEREAS, prior to the adoption of Ordinance 210 on <br />April 13, 1978, certain subdivision applications were granted <br />preliminary plat approval without the requirement for review and <br />approval of on-site sewage treatment system site evaluation reports* <br />and * <br />WHEREAS, certain of the above noted subdivision applications <br />have not yet been returned to the City for final plat approval; and <br />WHEREAS, under the laws of the State of Minnesota and the <br />ordinances of the City of Orono, preliminary plat approval does not <br />vest any rights with the subdivider prior to final plat approval; <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br />the City of Orono hereby declares that the intents and purposes of <br />Ordinance 210 supercede any previously granted preliminary plat <br />approval; that full compliance with Ordinance 210 shall be required <br />of all subdivision applications prior to final plat approval; and <br />that specifically wherein certain subdivision applications received <br />preliminary plat approval without city approval of septic system <br />site evaluation reports, such reports including all required on-site <br />percolation testing and soil borings, shall be required to be <br />submitted to and approved by the City prior to final plat approval
