Simmons <br />Chairman <br />Vice Chairman <br />Member <br />IN THE MATTER OF THE DETACHMENT) <br />FROM THE CITY OF INDEPENDENCE ) <br />•AND THE ANNEXATION TO THE CITY ) <br />OF ORONO ) <br />FINDINGS OF FACT, <br />CONCLUSIONS OF LAW, <br />AND ORDER <br />On June 21, 1973, the Minnesota Municipal Board received resolutions from the <br />City of Independence which requested tne detachment of certain property and the City <br />of Orono, which requested the annexation of the same territory pursuant to Minnesota <br />Statutes 414.061• <br />After review of the resolutions, the Minnesota Municipal Board hereby makes <br />and files the following Findings of Fact, Conclusions of Law and Order. <br />FINDINGS OF FACT <br />1. That a resolution supporting detachment of certain properties was received <br />from the City of Independence and a resolution supporting annexation of said property <br />was received from the City of Orono. <br />2. The resolutions contained all the information required by statute including <br />a description of the territory proposed for detachment which is as follows: <br />That part of the Southeast quarter of Section 36, Township 118, Range 24, <br />Hennepin County, Minnesota described as follows: <br />Commencing at the Southeast corner of said section, thence westerly along <br />the South boundary of said section 50 feet, thence northerly on a line <br />parallel to the easterly boundary of said section a distance of 1,170 <br />feet, thence easterly on a line parallel to the southerly boundary of said <br />section a distance of 50 feet, thence southerly along the easterly boundary <br />of said section l,170^more or less to the point of beginning. <br />3. The area proposed for detachment is situated within the City of Independence <br />and abuts the municipal boundary of the City of Orono. <br />CONCLUSIONS OF LAW <br />1. The Minnesota Municipal Board duly acquired and now has Jurisdiction of the <br />within proceeding. <br />2. An order should be issued by the Minnesota Municipal Board concurrently <br />detaching and annexing the area described herein. <br />ORDER <br />IT IS HEREBY ORDERED: That the following described property be, and the same <br />is hereby detached from the City of Independence and annexed to the City of Orono, <br />the same as if it had originally been made a part thereof: <br />That part of the Southeast quarter of Section 36, Township 118, Range 24, <br />Hennepin County, Minnesota described as follows:
