CHARLSON, SUBDIVIDER <br />THIS AGREEMENT, made and entered into this day of <br />, 1978, by and between the CITY OF ORONO, a municipal <br />corporation organized under the laws of the State of Minnesota (hereinafter <br />called "City"), and LYNN L. CHARLSON, his heirs, successors and assigns (herein <br />after called “Subdivider"). <br />WITNESSETH: <br />WHEREAS, the Subdivider has made application to the City Council <br />/ <br />for approval of a final plat of land within the corporate limits of the City <br />legally described in Exhibi.; A attached hereto and Incorporated herein by <br />reference (the "Subdivision"); and <br />WHEREAS, the City Council has granted preliminary approval to <br />the Subdivision, on the condition that the Subdivider enter Into this agreement <br />to provide for among other things, the Installation of streets, water, sewer, <br />other utilities, pathways, landscaping, and any other improvements hereinafter <br />described on the terms and conditions hereinafter set forth. <br />NOW THEREFORE, in consideration of the premises and of the <br />« <br />mutual promises and conditions hereinafter contained, it is hereby agreed as <br />follows: <br />1) a) Warranty of Subdivider. The Subdivider hereby warrants <br />and represents to the City as inducement to the City's <br />entering into this agreement, that Subdivider's interest in <br />the Subdivision is as set forth on Exhibit B attached hereto. <br />1) b) Covenants Concerning Title. Subdivider hereby warrants <br />that the title to the property in the Subdivision presently <br />and as of the time of the filing of the final plat for the <br />subdivision is as set forth in Exhibit B. <br />•i <br />Lynn L.
