The bays are limited to an area of 20
square feet-
Explain Request Relative to Requirements:
The Building Inspector has Issued a building permit for the construction of my
house on this property. To obtain the permit we adjusted the size of the house
and the location on the site to comply with the side lot restriction of ten feet.
One window bay on one corner of the house projects the allowable two feet (2')
into the side lot set back. Tlie projecting bay is approximately ten (10) square
feet in area. The building inspector issued the permit on the condition that
the foundation under the bay be cut back to the ten foot set back line. The
reason given for this requirement was that it did not qualify as a "bay” with
a foundation under it. Neither the ordinance nor the Building Code provide a
definition of a bay.
Extent of Non-conformity:
The extent of the non-conformity is a foundation and occupied space under a
^^oj®cting bay. ^e height of this portion above the grade is approximately
■ fvl
Hardships to Property (Your reasons for requesting this Variance or Conditional Use Permit)
The lot is substandard in that it is twenty feet (20*) less than the required
one hundred forty feet (140*) standard width. The property was recently
approved as a bulldable lot, I request a variance on a hardship basis
because of the substandard width of the lot to permit the foundatioc under
the bay.
A f
'm
'
% •
‘ \
^ \ -
I'.'-
fhiiir IS j.
