MIpTES OF A PLANNING COMMISSION MEETING HELD FEBRUARY 27, 1978 - PAGE 6 <br />#» <br />Mr, Rusch's father stated the property owners in <br />Liberty Acres each paid 1/5 of the cost to put in <br />the road and to maintain it and he felt there should <br />e some type of compensation paid by the new users <br />of the road to compensate the five homeowners <br />who already have paid the original cost and upkeep <br />of the road. Mr. Gardner replied he owns the <br />property where the road is located and that the <br />agreement he had was for the road to provide <br />egress and ingress. He felt the developer of <br />Liberty Acres had the sole responsibility, Mr, <br />Rusch's parents stated that was not so and that <br />the responsibility is on the homeowners in Liberty <br />Acres. <br />Chairwoman McDonald Informed the Ruschs that the <br />responsibility of the road was a private matter <br />and the interested parties should resolve the <br />problem. She added that the City would request <br />a copy of the agreement providing for access onto <br />Jamestown Road and the responsibility to the road. <br />Mr. Rusch's parents felt it would be a great <br />injustice if the access was approved as submitted. <br />The Zoning Administrator referred the Commission <br />o his original memo which had indicated this <br />could be a problem. He added that it is the <br />City's obligation to see that all these properties <br />have access onto the road. <br />Jim Olson felt It would be In the best Interest of <br />the City to have the access for the proposed lots <br />onto Jamestown Road and not onto County Road #6. <br />The Zoning Administrator explained the variances <br />which would be required. Including: 1) the existing <br />windmill on Lot 3 which Is only 13.2 ft. from the <br />property line and would require a 16.8 ft. variance; <br />and 2) the existing milk bam on Lot 2 which would <br />require a 2 ft. variance. <br />After all the public were heard the Public Hearing <br />was closed at 8:27 P.M. <br />Ct <br />Comalssloner Frahm nK>ved, Commissioner Hanmerel <br />seconded, a motion to reconmend approval of the <br />request for prellnilnary approval for a subdivision <br />y Karl Gardner at 2885 -> 6 th Avenue North with <br />'the following stipulations: <br />1) <br />2) <br />Payment of the park dedication fee of $1000 <br />An additional 10 ft. easement be provided <br />along County Road #6 for a 50 ft. right-of- <br />way, certified by the County Public Works; and <br />KARL GARDNER <br />#356 <br />(con* t) <br />■I
