The property and adjacent properties are heavily wooded and at different elevations. The <br />topographic map (Exhibit D) indicates the elevation change from the north to the south of the <br />property. <br />Conditional Use Permit for land alteration: <br />The property owner has requested a conditional use permit to permit land alteration on the <br />property over 500 cubic ya^. The proposal indicates approximately 2,360 cubic yards of fill <br />will be brought onto the site. The fill will be used to create a level area to locate the house, <br />provide good drainage and create access to the site for motor vehicles. <br />Average Lakeshore Setback: <br />The proposed residence encroaches 42’ into the average lakeshore setback. The proposed <br />residence is located further back on the property than the previous residence. However, it cannot <br />be moved further back due to the location of the sewer and a sewer easement. Planning <br />Commission should review whether there are any potential view impacts to the northerly <br />adjacent neighbor. <br />Statement of Hardship: <br />The applicant has included their statement of hardship in Exhibit B. The applicant should also be <br />asked for their testimony regarding this issue. <br />Engineer’s Comments: <br />The City Engineer has reviewed the plans. The comments are attached as Exhibit G. The <br />applicant has reviewed the comments and agrees with the five items indicated in the letter. <br />Vacation of the sewer easement may require a separate application process depending on how the <br />original easement was worded. <br />Issues for Consideration: <br />1. The proposed residence is set further from the lake than the old residence. <br />2. This lot and the adjacent lots are heavily wooded. <br />3. The proposed residence will not obscure neighboring properties views. <br />4. The proposed residence meets hardcover, lot coverage by structures and height requirements. <br />S.
