Turning the attic space into living space requires raising the existing roof. The applicant has not
provided floor plans but has provided 3 optional views of the new roof line. The new roof line
will need to meet the 30’ height requirement. Based on the elevation view provided by the*
applicant, it appears this will not be an issue. The ^licant is aware of the height limitation and
will design the project to meet it.
Statement of Hardship:
The an>licant has included their statement of hardship in Exhibit A. The applicant should also
be asked for their testimony regarding this issue.
Issues for Consideration:
1. The existing residence was built in 1960 prior to current zoning standards.
2. The raising of the roof will not affect the adjacent neighbor.
3. If the subject property were in one acre zone, it would meet the side yard setback requirement.
4. Lot coverage by structure is not increasing with the proposed project.
5. Other issues raised by the Planning Commission.
Staff Recommendation:
Staff recommends approval ot the side variance to convert the attic space into living area of the
existing residence with the condition the project meets the 30’ height requirement.
Additional Survey Work Required
Applicants have provided a partial survey confirming the existing right side setbacks which are
the subject of the requested variance. However, the only other survey on file does not confirm
the setbacks for the remainder of the house. Staff is concerned that the addition and/or the
proposed overhangs on the rear of the left side of the addition may encroach into the 50 ’ t^uired
rear yard. Applicants will be required to provide a survey confirming setbacks for the entire
house before this is forwarded to to Council.
M)2>2848 Peter/Amy Goshgarian
too Orono Orchard Road
11/15/2002
Page 2 of2
