A. The cupola is decorative, does not increase living space. <br />B. The cupola is in character with the neighborhood. <br />C. Hardcover and lot coverage by structures does not increase with the cupola. <br />D. There is no access from the residence to the cupola. <br />E. The residence meets all hardcover, setbacks, height, and lot coverage by structures <br />requirements. <br />5. The City Council finds that granting a conditional use permit will not be detrimental to the <br />health, safety or general welfare of the public, will not adversely affect light, air nor pose a <br />fire hazard or other danger to neighboring properties, nor will its use depreciate surrounding <br />property values and that the proposed level of use of the property will be in keeping with the <br />intent and objectives of the Zoning Code and Comprehensive Plan of the City. <br />6. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by staff and comments of the <br />applicants and the affect of the proposed use on the health, safety, and welfare of the <br />community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants a <br />conditional .use permit per Municipal Zoning Code Section 10.75, Subdivision L to permit <br />construction of a cupola on the roof of a residence to be 34.5* where 30 ’ height is the ma.x-»lhum for <br />the LR-IC zoning district, subject ,o the following conditions: <br />1. Council approval is based on the site plan submitted by the applicant attached to this <br />resolution as Exhibit A. Any amendments to the site plan may require further <br />Planning Commission and City Council review. <br />2. Authorities granted by this variance run with the property not with the applicant, but <br />are permissive only and must be exercised by application for a building permit within <br />one year of the date of Council approval, or these variances will expire on that date <br />(December 9,2003). <br />Page 2 of 5
