Metropolitan Council <br />Building communities that work <br />December 4,2002 <br />Sara Irvine, City Administrator <br />City of Minnetonka Beach <br />2945 Westwood Road <br />PO Box 146 <br />Minnetonka Beach, MN SS36I <br />DEC 9 2002 <br />Cl IY OH OHOno <br />••• : "O <br />r,.v t s rr ') <br />Qlt or UriONO <br />RE: City of Minnetonka Beach Comprehensive Plan Update <br />Metropolitan Council District 3 <br />Metropolitan Council Referral File No. 18600-1 <br />Dear Ms. Irvine: <br />The purpose of this letter is to confirm recent communications between the City of Minnetonka Beach <br />and the MetropoliUn Council regarding the plan review process and the current City Council's proposed <br />agenda to take final action to adopt and implement the comprehensive plan at its December 9,2002 <br />meeting. <br />Please be advised that the Metropolitan Council has not yet completed its formal review of the plan. <br />Minnesota Statutes Section 473.175, Subdivision 2 says in part: <br />No action shall be taken by any local governmailal unit...to place any such comprehensive <br />plan...into effect until the (Metropolitan] Council has returned the statement to the unit and until <br />the local government unit has incorporated any modifications in the plan required by a final <br />decision, order or judgement pursuant to section 473.866. <br />Minnesota Statutes Section 473.175, Subdivision 2 also says in part: <br />Within 120 days following receipt of a comprehensive plan of a local governmental unit, unless a <br />time extension is mutually agreed to, the [Metropolitan] Council shall return to the local <br />governmental unit a statement containing its comments and, by resolution, its decision, if any, to <br />require modifications to assure conformance u ith the metropolitan system plans <br />Metropolitan Council records indicate that the Metropolitan Council received the City's comprehensive <br />plan on August 9, 2001. Metrop«>litan Council staff found the comprehensive plan incomplete fiw review <br />purposes at that time and the review was suspended. I\>llowing a Submittal received by the Metropolitan <br />Council on July 18, 2002, Metropolitan Council staff found the City’s comprehensive plan submittal <br />complete for review and the Metropolitan Council ’s fonnal review commenced. <br />In a letter dated July 3 1, 2002, sent by Phyllis Hanson. Manager of the Council ’s Office of Planning and <br />Technical Assistance, the City was notified that the Metropolitan Council expected to complete its review <br />by November 15, 2002, which is I20da>s from July 18, 2002. <br />On September 23, 2002, the Metropolitan Council received a faxed copy of a letter from Minnetonka <br />Beach Planner and Zoning Administrator, Richard Krier. requesting an e.xtcnsion to the review period <br />from 120 to l80-da>s to allow additional time to resolve the County Road designation and regional trail <br />identification issues.
