The Plans include a <br />provision for emergency vehicle access between Kelley Parkway and East Lane. <br />The Developer has demonstrated to the satisfaction of the Cuy Council that the <br />development as proposed is in compliance with all the wetland protection and <br />mitigation requirements of the Minnehaha Creek Watershed District as administrator <br />of the WCA regulations on Orono’s behalf. <br />The Developer has provided market study information confimiing that the proposed <br />residential units at the proposed pricepoints are marketable and will provide housing <br />options generally needed within the Orono area. <br />The Developer has submitted a Preliminar>' Plat providing for the creation of Lots, <br />Outlets, drainage and utility easements and public right-of-way dedications generally <br />in conformance with the approved General Concept Plan. <br />* WHEREAS, the Applicants have agreed to execute Planned Unit Development No. <br />4 Agreement providing for the installation of certain public and private improvements as a condition <br />of General Development Plan approval, which agreement will additionally documents the general <br />and detailed conditions for use and development of the Property, and <br />WHEREAS, the Developer has completed or has agreed to complete all other <br />requirements of the Zoning Code and related Ordinances of the City including but not limited to: <br />1.
