Section 10.03, Subdivision 9 (F): Accessory Building-Plumbing: Installation of any combination <br />of Fixtures requiring wastewater plumbing that includes a toilet, shower or bathtub shall be allowed <br />only in an accessory building that is conforming in location, size and height. <br />Application Summary: The applicants have applied for a conditional use permit to allow <br />plumbing in an accessory building. The accessory building will be used as a “work/storage <br />room". It will be detached, 32 ’ x 60 ’ (1,920 s.f.), and located north of the residence. The <br />work/storage room will be used for personal use and will include a bath room with sink and toilet. <br />The property is located in the RR-1A zoning district. The City of Orono allows for the provision <br />of plumbing in accessory buildings that includes a toilet, shower or bathtub. The accessory <br />building is required to be conforming in location, size, and height. The accessory building <br />(detached garage) does conform to location, size and height requirements set by code. <br />In September 2002, the applicant applied for a building permit to construct the accessory building. <br />Before a permit was issued setback, size and height requirements were reviewed for conformity. <br />The accessory building meets all setback requirements for the RR-1 A zoning district. When the <br />permit was issued the applicant was informed of the need for a conditional use permit. <br />On-Site Septic System: <br />The subject property is serviced by an on-site septic system. The location of the storage <br />building will not interfere with the current septic system or future sites within the property. <br />The existing septic system is conforming but located on the other side of the property and <br />residence. The applicant is planning to install a holding tank because the accessory building is <br />located at an elevation and distance where hotAing into the existing septic system is not <br />technically feasible. The holding tank will be used for hadiroom facilities only. The garage <br />will not have any laundry or shower/tub facilities. The accessory structure does not qualify <br />frtnn the Zoning Code or Building Code to be used as a guest house or dwelling unit. The
