B. The topography of the property is such that runoff will drain toward the <br />lake and not toward neighboring properties. All the property within 75' of <br />the lakeshore will provide an adequate absorption area. <br />C. The adjacent proper ties are not affected by the garage and foyer addition. <br />D. A portion of the garage addition is over existing driveway hardcover. <br />E. The lot coverage by structures is well below the allowed 15%. <br />F. The property has water on two sides, with aln: ^st 80% of the property within <br />75’ of the l^eshorc. <br />4. The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />variance will not adversely affect trafHc conditions, light, air, nor pose a fire haza.*‘d <br />or other danger to neighboring property; would not merely serve as a convenience to <br />the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments <br />by the applicant and the effect of the proposed variances on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />a variance to Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision <br />16 (L)(2) to permit 4,965.4s.f (33.0%) hardcover in the 75-250' lakeshore setback where 4,965.4 s.f <br />(30.8%) hardcover exists and 3,706.5 s.f (25%) is allowed to permit construction of an attached <br />garage and foyer to the existing residence. Approval is subject to the following conditions: <br />1. Council approval is based on the site plan submitted by the applicant attached to this <br />resolution as Exhibit B.
