Mr. Morse <br />The following is a letter of appeal to an administrative decision to allow direct access from Fox <br />Street to Lot 2 of Beau Marais for review on October 14 Orono city council meeting. <br />Referencing city of Orono : resolution of the city council number 3577 line item number 7 <br />stating: (lot 2 of the original Beau Marais plat would contiime to gain access via the existing <br />easement drive) and under city of Orono transportation plan: access management; (direct <br />individual property access to arterials is regulated in the Orono municipal code by limiting the <br />number of curb cuts per residence; by prohibiting direct access to principal arterials, and by a <br />number of the other regulations involving the location type and number of access points to the <br />arterials roadway system. <br />Allowing access to Lot 2 only from the existing easement drive forces an approach to the <br />property that would be to steep of an incline based on grade conditions. Furthermore, access of <br />the property to avoid the steep incline would promote the loss of approximately 7-10 mature <br />trees, lliis in essence goes against resolution of the city council number 3577 item 6 trying to <br />salvage existing trees. <br />Moreover, it is the city ’s policy under access management to (minimize the number of new direct <br />access to principal and minor arterials). However per city of Orono, Fox Street in rtot a principal <br />or minor arterial. Because of the mature planting and the steep grade change of the property at <br />point of access, an unusual hardship to the property would result and have a negative impact <br />upon the aesthetics and sensitive environment. <br />We believe the intent of resolution of city 3577 i.e. tree conservation and overall aesthetics <br />would be better suited by allowing access from Fox Street than the easement driveway. <br />Sincerely, <br />lames E McN( <br />Formation Architects
