% <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE NO.02-2827 <br />WHEREAS, Sven Gustafson, (hereinafter "the applicant") is the ouner of the <br />property located at 4515 North Shore Drive within the City of Orono (hereinafter "the City") and <br />leg^ly described as follows: <br />Lot 8, Bergquist’s Addition to Saga Hill, Hennepin County, Minnesota, (hereinafter <br />“the property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.24, Subdivision 5 (B) to permit new residential construction on a .54 acre <br />lot where 1 acre is required and on a lot that is 55’ wide where 140’ is required in the LR-1B district. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Plaiming Codes, the Orono Plaruiing <br />Commission held a public hearing on September 16,2002, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Miimesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #02-2827. <br />2.The property is located in the LR-IB Zoning District, where 1 acre is the minimum <br />required lot area. The property consists of approximately .54 acres. <br />3.The Orono Planning Commission reviewed this application on ^ ;ptember 16,2002 <br />and recommended approval of the proposed variance based upon the following <br />finding.s: <br />A. The property has been developed with a residential use since the early 1950's. <br />B. The site plan indicates the proposed setback 10* to the side property li.ies, 30' <br />Page 1 of 6
