4. <br />5. <br />B.The site plan indicated the proposed setback 1 O' to the side property lines, 30' <br />to the rear property line which meet the minimum requirements of the LR-1B <br />zoning district. <br />C. <br />D. <br />E. <br />The lot was platted prior to current zoning requirements. <br />There is no additional land to combine with the property. <br />The new residence will be in the same general location as the existing <br />resioence. <br />F. The non-conforming location of the residence to the east leaves a small, <br />approximately 1 Sā wide building area meeting the average lakeshore setback. <br />G. Drainage concerns expressed by the neighboring property owner can be <br />addressed through suitable drainage and grading plan. <br />The City Council finds that the conditions existing on this property are peculiar to t <br />and do not apply generally to other property in this zoning district; that granting the <br />variance will not adversely affect traffic conditions, light, air, nor pose a fire hazard <br />or other danger to neighboring property; would not merely serve as a convenience to <br />the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments <br />by the applicants and the effect of the proposed variances on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />a variance to Municipd 2^ning Code Section 10.24, Subdivision S (B) to permit new residential <br />construction on a .54 acre lot where 1 acre is required and an encroachment of 45 ā into the average <br />Page 2 of 6 <br />J
