MN 55391 <br />Dear Mr. Briggs: <br />As you know, the City has been following up on a number of complaints by your neighbor to the east <br />regarding the marina operation. The attached letter is the City’s response to the neighbor’s <br />complaints. It is our conclusion that while certain of the complaints can and should be resolved, <br />others fall into the realm of legal nonconformities which the City will not pursue until or unless the <br />marina is redeveloped or you choose to commence one of the conditional uses allowed in the B-2 <br />Zoning District for which a Conditional Use Permit is required. <br />Therefore, the City is directing that you take immediate action to resolve the outstanding issues, as <br />follows: <br />1. <br />2. <br />3. <br />4. <br />5. <br />Repair the fence along the east side of the property, as we discussed on June 10, as required <br />per Zoning Code Section 10.03, Subd. 15(G)(5). <br />Lower the stack of stored blocking materials along the east boundary to be no more than 6 ’ <br />in height, and no closer than 5' to the east lot boundary. Continue to store ail such materials <br />in an orderly fashion on the site, and at least 5' from the east lot boundary. Continue to keep <br />the site in a neat and orderly manner per Code Section 10.41, Subd. 11(F). <br />Remove the stored dock floats and any other miscellaneous materials that are stored within <br />5 feet of the easterly lot boundary. Continue to maintain a 5-foot setback from the east <br />boundary for storage of all materials, including boats. <br />To the extent that debris from the marina finds its way to the adjoining property, remove that <br />debris as soon as you become aware of it. <br />Immediately complete the replacement and conversion of the exterior lighting system to <br />direct sources of light away from the adjoining property, as required per Code Sections 10.41, <br />Subd. 11(C) and 5.43 Subd. 5(C).
