First of all, it appears that a majority of the issues you have noted are operational <br />issues, Nshich require ongoing action by the marina, as opposed to physical issues which are only <br />resolved by a change to the physical aspects of the marina. Certain conditions at the marina are <br />viewed by the City as legal nonconformities because those conditions pre-date codes which might <br />address them. Consequently, the City will not take action on certain items because of their legally <br />nonconforming status. <br />The following addresses your list in the order you presented the issues: <br />1) Dumpstffmeeds to be shielded *. Code Section 10.41, Subd. 1 1(G) requires that dumpsters <br />be “screened so as to not be visible off-site ”. This language was added to the ordinance in 1995. <br />The absence of pro.\imate dumpster screening is a pre-existing legally nonconforming condition for <br />this marina. <br />The existing dumpsters on the property are located on the east side of the building. They are <br />screened by the building on the west, by the 6’ high property line fence on the east, and are located <br />approximately halfway between the lake and the road, such that at most times during most seasons <br />they are not clearly visible from the lake or the road. These dumpsters are in one of the least visible <br />locations possible on the site. Further, the only additional screening the City might require if this <br />code was enforced for existing businesses, would be a 5-6’ high fence along the north and south sides <br />of the dumpster. It is our opinion that this would not have a significant impact on views of the <br />dumpster firom off-site. The City has not required other existing marinas to make physical changes <br />to the site to screen their dumpsters absent a redevelopment of the marina.
