• $ <br />A RESOLUTION GRANTING VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 (B), <br />FILE NO. 02-2811 <br />WHEREAS, Daniel Parten and Ruth Parten, husband and wife, (hereinafter “the <br />applicants") arc the owners of the property located at 1015 Tonkawa Road within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Lot 1, Block 1, Carlwood, Hennepin County, Minnesota, (hereinafter “the property"); <br />and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.22, Subdivision 1 (B) to allow encroachment of 18 feet into the average <br />lakeshorc setback to construct an addition and deck to the lake side of the existing residence. <br />W'HEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plaiming <br />Conunission held a public hearing on August 19,2002, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by ll.e City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File f^02-2811. <br />The property is located in the LR-IB Zoning District, where 1 acre is the minimum <br />required lot area. The property consists of approximately 90,990 s.f. (2.089 acres). <br />3.The Orono Planning Conunission reviewed this application on August 19,2002 and <br />recommended approval of the proposed variance based upon the following findings: <br />A. Neighbors views of the lake will not be negatively impacted by the addition. <br />B. Hardcover in the 7S-2S0* setback zone will not change, nor will lot coverage <br />1 of5 <br />i
