r <br />Council Exhibit B <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2; SECTION 10.56; <br />SECTION 10.56, SUBDIVISION 16 (L) (2); <br />SECTION 10J5, SUBDIVISION 6 (B); AND <br />SUBDIVISION 16 (L) 2 <br />FILE NO. 02-2786 <br />WHEREAS, Johnathon R. Jones, (hereinafter "the applicant") is owner of the <br />property located at 3490 North Shore Drive within the City of Orono (hereinafter "the City") and <br />legally described as follows: <br />Lot 3, Block 3, Baldur Park, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicant revised the application and submitted a new plan on July <br />15,2002 requesting variances to Municipal Zoning Code Section 10.22, Subdivision 2 and Section <br />I0.S6, Subdivision 16 (L) 2 to permit hardcover greater than 2S% in the 75-250 ’ lakeshore setback <br />where 1,687 s.f. (25%) is allowed, and variances to Section 10.25, Subdivision 6 (B) to permit <br />redevelopment of the property less than the minimum lot size and lot width for the zoning district; <br />and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on May 20,2002 and was continued to June, 17,2002 and July <br />15,2002, at which time all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota; <br />FINDINGS <br />1.
