A RESOLUTION GRANTING VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5(B), <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.56, SUBDIVISION 16(LK2), <br />FILE NO. 02-2798 <br />WHEREAS, Fred Shearer and Karen Shearer, husband and wife, (hereinafter "the <br />applicants") are the owners of the property located at 1405 Park Drive within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Lots 1, Block IS, Saga Hills Revised, including the adjacent part of vacated streets, <br />Hennepin County, Minnesota (hereinafter “the property"); and <br />WHEREAS, the applicants ha\e applied to the City for a variance to Municipal <br />Zoning Code Section 10.24, Subdivision 5 (B). Section 10.22, Subdivision 2 and Section 10.56, <br />Subdivision 16 (L)(2) to permit construction of a third stall garage to the existing residence to be <br />located 9.8 ’ from the side property line where 10’ is required. 27.9 ’ from the front property line <br />where 30’ is required in the LR-IB zoning district and to permit 4,376 s.f. (28.9%) hardcover in the <br />75-250’ lakeshore setback where 4,363 s.f. (28.8%) hardcover exists and 3,779.75 s.f. (25%) is <br />allowed; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on July 15,2002, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File ff02-2798. <br />The property is located in the LR-IB Zoning District, where 1 acre is the minimum <br />required lot area.
