property will be in keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />.6.I1ie City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by staff and comments of the <br />applicants and the affect of the proposed use on the health, safety, and welfare of the <br />community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby approves a <br />conditional use permit per Municipal Zoning Code Section 10.20, Subdivision 3 (M) to permit the <br />keeping of I additional horse on the property, keeping a total of three horses on the property, subject <br />to the following conditions: <br />1. <br />3. <br />4. <br />5. <br />This Conditional Use Permit has is valid for a time period of 10 years from the <br />time of Council approval. Such approval allows the property to be used for 3 <br />horses for a period of 10 years. After 10 years the property would revert back to <br />allowing only 2 horses. Such use for two horses would continue to be a legal non- <br />conforming use. <br />The non-conforming use shall be allowed to remain until such time the use ceases <br />for a period of 12 months. Any future use shall then oe in conformance with all <br />zoning regulations. <br />The applicants and any future property owners shall maintain an adequate manure <br />management program. The City of Orono reserves the right to review this <br />conditional use permit should it be determined there is a significant environmental <br />concern related to the approvals granted by this Conditional Use Permit. <br />Authorities granted by the conditional use permit run with the property not with the <br />applicants. <br />Violation of or non-compliance with any of the terms and conditions of the <br />conditional use permit approval shall constitute a violation of the zoning code, shall <br />automatically terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />Page 3 of 7
