Ficktel stated <br />they would only contain evergreens because they needed trees that would not be affected <br />by the exhaust of the cars, and also that would not drop sap, etc. on the cars. <br />Sanseverc moved, and Murphy seconded, to approve the site plan review subject to <br />the Planning Commission's recommendations, with the clarification that parking <br />rntrictions noted in item 2 referred to the east lot only, and directed staff to draft a <br />rnolution for the next City Council meeting. <br />Vote: Ayes 5, Nays 0. <br />8. 802-2796 Mark and Gina Kosek, 1875 Shadywood Road, Variance <br />Gina Kosek was present. <br />Bottenberg stated that the application was to construct nvo decks and a walkway. One <br />deck would be at ground level, and the other off the second story. Currently there are 3 <br />patio doors on the lakeside of the home with no means of exiting the house. The total of <br />the decks would equal approximately 110 s.f. <br />Bottenberg stated that the applicant had bought the property with the intention of <br />remodeling the existing house. After reviewing the foundation and other structural <br />limitations decided to tear down the house and then applied for a variance to allow a deck <br />within the 0-75’ lakeshore. The request was denied at the Planning Commission level. <br />The applicant then submitted building plans. At that time the hardcover complied at <br />approximately 22% in the 75-250’ setback zone, leaving 485 s.f. of hardcover to use. The <br />driveway and some retaining walls were constructed after the house was completed and <br />the certificate of occupancy was issued. The retaining walls were constructed to aid in the <br />change of grade for the driveway. When the applicant constructed retaining walls, she did <br />not know they were considered hardcover. There was also a second driveway on ihe <br />property that has been converted to grass at the instruction of the Planning Commission. <br />The Planning Commission voted to allow the two decks with the following conditions to <br />reduce the amount of hardcover on the property: <br />1. Remove the south driveway and replace with grass. <br />2. Remove shed located In 0-75’ setback. <br />3. Remove all stone borders. <br />4. Remove all unnecessary boulder walls. <br />Bottenberg stated that Kellogg had visited the site and determined that unnecessary stone <br />wall removal would result in a hardcover reduction of 50 s.f. (.29%).
