Mr. Chalfen asked us to <br />write in support of the Planning Commission’s recommendation to deny the referenced <br />application by Mr. and Mrs. Revis Stephenson HI for an afler-the-fact amendment to a <br />conditional use permit (CUP) and variance at their property at 1850 Fox Ridge Road. The after- <br />the-fact amendment and variance requested by the Stephensons are unacceptable under City <br />ordinances and other governing law. We therefore urge the City Council to reject the <br />Stephenson’s application and order the Stephensons to re-grade the property to conform to the <br />original CUP. <br />Zoning Administrator Weinberger included in the Request for Council Action copies of an <br />Affidavit of Richard Chalfen and a letter from me. That affidavit and letter set out the basis for <br />our objections to Mr. Stephenson’s applications, which we will not repeat here. We are writing <br />now to express our support for the Planning Commission recommendation to reject the <br />Stephensons’ request for after-the-fact conditional use permit and variances.
