Nursery has applied to amend PUD Agreement #1 that was executed with the <br />approval of the East Willow Woods in 1990. Council directed staff to redraft the PUD <br />Agreement approving the concession stand use and to include a Class I Restaurant as a permitted <br />use on Lot I. <br />Staff Recommendation <br />Staff recommends Council adopt the attached PUD Amendment allowing a concession stand use <br />on the property subject to the conditions noted below, and to add Class I Restaurants as a <br />permitted use for Lot I. <br />I.Primary access to the concession stand area shall be from within the existing retail <br />nursery space. No separate access shall be permitted that would be intended to be the <br />primary' access. <br />Any request to expand the concession stand use beyond a cafeteria use shall be reviewed <br />as an amendment to the PUD Agreement. <br />3.Expansions to the concession stand use would be any increase to the seating capacity <br />beyond 44. dedicating more than 500 s.f of the floor area of the building to public <br />seating area or devoting more than 900 s.f. to the restaurant use. <br />4.The hours of operation of the concession stand shall be limited to the normal operating <br />hours of the retail to which it is accessory. <br />COUNCIL ACTION REQUESTED <br />Motion to approve Amendment #2 to PUD Agreement No. I allowing a concession stand use <br />within the nursery area and adding “Class I Restaurants ” as a permined use for Lot I.
