Because new areas of impervious surface are proposed, engineering information regarding the <br />drainage area and rate calculations must be submitted by the applicant and approved by the City <br />Engineer prior to Council review of the application. Applicant is advised to contact the Minnehaha <br />Creek Watershed District to determine what approvals may be required. <br />9. Applicant shall be placed on notice that future access to the property may change and applicant <br />agrees to discuss the issue of access at such time the City or adjacent property owners initiate such <br />discussions. <br />10. The industrial zoning district does not permit retail sales in the industrial distict. Such approvals <br />granted within this site plan and conditional use permit allow only wholesale operations, body work, <br />and warehousing with intent to distribute product. Such use would include fleet sales of automobiles <br />to a commercial or corporate customer and w holesale trade of parts from the site. No advertising, <br />lighting, or displays are permitted when the intent is to attract drive-by customers. <br />1 1 . The signage is approved as submitted. Any additional signage shall require additional review. <br />12. Noise of the operation shall be in conformance with the Noise Ordinance. <br />13. Hours of operation shall be limited to hours as such that would be consistent w ith the fleet sales <br />operation of the business. Applicant shall provide additional information as it relates to hours of <br />operation of the site. <br />14. Such conditional use permit for outside display and outside storage shall be subject to periodic <br />review as deemed necessary' by the City of Orono. <br />Staff Recommendation <br />Although the proposed development plan is short of the redevelopment to high tech'medical <br />envisioned in the City's Comprehensive Plan, the proposal is compatible w'ith the surrounding <br />land uses, and the applicant has been cooperative in terms of addressing issues that w ill affect <br />the appearance of the site. Staff supports the conditions set out in the Planning Commission's <br />recommendation. <br />COUNCIL ACTION REQUESTED <br />Motion to direct Staff to draft a resolution for adoption on Council July 22, 2002. <br />I
