A <br />A RESOLUTION GRANTING PRELIMINARY <br />APPROVAL FOR A TWO LOT SUBDIVISION <br />OF PROPERTY LOCATED AT <br />250 NORTH SHORE DRIVE WEST <br />PID 06-117-23 23 0001 <br />FILE NO. 02-2788 <br />WHEREAS, Bradley Pass and Carol Pass, (hereinafter "the subdividers") on April <br />17,2002 filed an application with the City of Orono (hereinafter "the City") requesting subdivision <br />of property located at 250 North Shore Drive West within the City of Orono and legally described <br />as follows: <br />That part of the Southwest Quarter of the Northwest Quarter of Section 6, Township <br />117 North, Range 23 West of the 5* Principal Meridian, lying north of the South <br />854.5 feet of said Southwest Quarter of the Northeast Quarter, Hennepin County. <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Subdivision Codes, the Orono Planning <br />Commission held a public hearing on June 17,2002, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />WHEREAS, at their regular meeting held on June 24,2002 the Orono City Council <br />considered the subdivision application of the subdivider noting the following findings of fact: <br />FINDINGS <br />The layout of the lots meets the Zoning Code requirements for a front/back lot subdivision <br />1. <br />2. <br />The proposed use of the land is consistent with the intent of the Comprehensive Plan. <br />The conservation easements over the east 5 acres and the eastern property would <br />eliminate the need to create a road extension since the total additional building sites <br />would only add one to North Arm Lane. The North Arm Lane corridor is not fully <br />developed to typical road standards. When the east property develops with an additional <br />residential lot the condition and upgrading of the road will have to be determined at that <br />time. <br />Page 1 of 6 <br />1 <br />i
