#02*2789 Notice of Planning Commission Action <br />May 29, 2002 <br />Page 2 <br />4. Motion to recommend that the retail uses allowed be accessory to the residents of this <br />development and the surrounding community. <br />(Vote: 7 For, 0 Against) <br />Plaiming Commission discussed but did not reach a conclusion as to whether the retail clement <br />should include the proposed grocer)' store. Planning Commission members did not conduct a <br />detailed review of the various elements of the concept plan, and limited their action to <br />recommendations regarding the proposed amendments to the Community Management Plan, <br />leaving the issues of rezoning and concept plan review for future mccting(s). <br />Applicant's ne.\t scheduled meeting is confirmed as: <br />City Council - Monday, June 10, 2002; meeting starts at 7:00 p.m. <br />The Council will be presented with the Planning Commission's recommendations regarding tl.. <br />proposed amendments to the CMP. Council will be asked to provide applicants with guidance <br />in terms of two critical issues which arc key to the review process moving forward: I) whether <br />the CMP amendments have Council support, and 2) whether the grocery element has Council <br />support. Council will be asked to provide additional direction to the Planning Commission <br />with regards to any elements of the concept plan if any which Council has concerns with at <br />this time. <br />If Council supports the proposed amendments to the CMP. the concept plan review process <br />will continue at the Planning Commission. <br />Minnesota Statutes §15.99 requires that the City must approve or deny zoning applications <br />within 60 days of receipt of the completed application. The statute also provides that the City <br />may extend the review period for an additional sixty days upon written notification to the <br />applicant. Your application was received and deemed complete as of April 17, 2002, and the <br />initial 60-day period will expire on June 16, 2002. The City of Orono hereby extends the <br />deadline for application #02-2789 an additional 60 days to August 15, 2002. The reason <br />for the extension is that the Planning Commission meets once per month and will not meet <br />again until June 17; the Planning Commission has not yet made a recommendation on the <br />concept plan; and Council action on your request cannot occur until after the Planning <br />Commission makes a recommendation on the concept plan. These factors will not allow the <br />City to complete its review and take action within the initial 60-day timeframe. <br />If you desire certified copies of the official Planning Commission minutes, they are available <br />from the City Recorder after review and approval by the Planning Commission.
