Section 10.03, Subdivision 9(F): Accessory Building-Plumbing: Installation of any combination <br />of fixtures requiring wastewater plumbing that includes a toilet, shower or bathtub shall be allowed <br />only in an accessory building that is conforming in location, size and height. <br />2. Section 10.03, Subd. 9 (C): Size Restrictions & Conditions for Oversize Accessory <br />Structures: The maximum oversize accessory structure footprint for a lot of 6.9 acres is 2,400 s.f. <br />Application Summary: The applicants have applied for a conditional use permit to allow <br />plumbing in an accessory building. TTie accessory building will be used as an “work/storage room.” <br />It will be detached, 30' x 50’ (1,500 s.f.), and located north of the residence. The work/storage room <br />will be used for personal use and will include a bathroom with sink and toilet. <br />The property is located in the RR-1B zoning district. The City of Orono allows for the provision of <br />plumbing in accessory buildings that includes a toilet, shower or bathtub. The accessory building <br />is required to be conforming in location, size, and height. The accessory building (detached garage) <br />does conform to location, size, and height requirements set by code. <br />The accessory building meets all setback requirements for the RR-1B zoning district and the square <br />footage of the building meets the size restrictions of the oversize accessory structure ordinance. This <br />properly is located on Dickey Lake. Hardcover is not an issue with this application. <br />The applicant has agreed to filing the two appropriate restrictive covenants on the property: <br />accessory building with plumbing and oversized accessory building. <br />PLANNING COMMISSION: <br />The Planning Commission recommended by a 7 to 0 vote to: <br />Approve the application as presented. <br />STAFF RECOMMENDATION: <br />To approve the enclosed resolution. <br />1
