#02-2772 John and Donna Crotteau <br />I40S Sixth Avenue North <br />Page 3 of4 <br />4. A detached building 750 s.f. or less is only required to meet a 10 ’ side setback. The <br />detached building must have a minimum of 10 ’ separation between it and the principal <br />building. Sliding the garage back to be 10 ’ from the principal building also moves the <br />garage back out of the 30’ top of bluff setback, thus eliminating the need for any <br />variances for the garage. <br />DNR Review and Commcats <br />When projects have a potential impact on natural features, such as a bluff, the City of Orono will <br />typically request comments from the DNR. The Planning Commission did not have the benefit of <br />the recommendation provided by the DNR for their review. A copy of the DNR comments are <br />attached. <br />The DNR objects to the portion of the project that further impacts the bluff and suggests the <br />project be scaled back. In a phone conversation with Peter Leete, of the DNR, he stated there was <br />no objection to the portion of the project that was located away from the lakeside. <br />In response to the DNR comments the plan was further reviewed to determine all potential <br />negative impacts to the bluff and existing grades on the property. The total ground elevation <br />from the house to the end of the addition is approximately 2-3’. The property begins a more <br />dramatic drop where the exterior wall of the lakeside addition is proposed to end. Access around <br />the house would become difficult without creating a flat area in front of the addition. The land <br />alteration to create a walking path around the front of the house would require additional land <br />alteration and fill that is not permitted on a bluff. <br />Analysis <br />The original construction of the house was in 1984, prior to the adoption of the Shoreland <br />Ordinance in 1992. The Shoreland Ordinance also regulates areas defined as a “bluff ’. Nearly <br />the entire 10.4 acre property is defined as either a wetland or is protected bluff area, including all <br />the land in which the existing house is located. The house is located well above the 930’ wetland <br />elevation. The actual house elevation is approximately 987 ’. <br />The City Engineer has reviewed the plans and has commented the proposed additions to the <br />building do not present any concerns from an engineering perspective. Mr. Kellogg did state silt <br />fence shall be installed lakeside of the home prior to any construction or site grading. The <br />MCWD will also have the same requirements and require permits of their own. <br />A large wetland is located at the base of the bluff area, between the lakeshore and the house. The <br />wetland basin covers approximately S acres in area. The dr.'inage from the house enters the <br />wetland prior to entering the lake.
