Section 10.03, Subdivision 10: Conditional Use Permit-Accessory Structures: All accessory <br />structures on through lots located in “R” districts shall require a conditional use permit. <br />Application Summary: The applicant is proposing to construct two accessory structures on <br />the property behind the residence: a sport court and a pool. The applicant is proposing to locate the <br />accessory structures appro.ximately 70' (sport court) and 250' (pool) from the rear property line. <br />A conditional use permit is required because this property is considered a “through" lot. By zoning <br />code definition a “through” lot is a lot which has a pair of opposite lot lines abutting two <br />substantially parallel streets, and which is not a comer lot. On a through lot, both street lines shall <br />be front lines for applying the Zoning Chapter. The lot abuts streets on two sides: Country side Drive <br />West and Old Crystal Bay Road. <br />Primary access to the residence is from Countryside Drive West. <br />The property contains a private sewage septic system. The proposed accessory structures will not <br />interfere with the primary or alternate septic sites. <br />PLANNING COMMISSION: <br />The Planning Commission recommended by a 7 to 0 vote to: <br />Approve the application as presented. <br />STAFF RECOMMENDATION: <br />To approve the enclosed resolution. <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution.
