White seconded, to approve and adopt RESOLUTION NO. 4789, a Resolution <br />Granting a Conditional Use Permit to allow plumbing in an accessory building for the property <br />located at 3120 North Shore Drive. VOTE: Ayes 4, Nays 0. <br />*(#I0) #02-2775 TEMPLE ISRAEL, 645 TONKAWA ROAD - CONDITIONAL USE PERMIT - <br />RESOLUTION NO. 4787 <br />Flint moved. White seconded, to approve and adopt RESOLUTION NO. 4787, a Resolution <br />Granting a Conditional Use Permit to permit construction of a pre-manufaclured pavilion on the <br />property located at 645 Tonkawa Road. VOTE: Ayes 4, Nays 0. <br />(#11) #02-2778 KEVIN MANLEY ON BEHALF OF MANLEY BROTHERS CONSTRUCTION, <br />1973 EAGERNESS POINT ROAD - VARIANCES - RESOLUTION NO. 4788 <br />Mr. and Mrs. Kevin Manley, Applicant, were present. <br />Weinberger stated the Applicant is requesting a variance to the 75 ’ lakeshore setback to allow the existing <br />residence to be raised from a one and a half story to a full two-story. The second story addition would <br />raise the building height by approximately ten feet. The expansion of the building is actually occurring <br />behind the average lake setback. <br />The applicant is also requesting a variance to construct a 14 by 8’ deck located between the garage and <br />the house. The deck requires variances to permit the total hardcover in the 75-250’ setback to be <br />increased from 27.7 percent to 30.2 percent. Weinberger noted the structural lot coverage on the property <br />would also increase from 18.3 percent to 19.4 percent. The applicant has submitted information to the <br />City regarding the previous condition of the property prior to purchasing the property, noting that a <br />considerable amount of hardcover, including a deck and patio, has already been removed. <br />The Planning Commission recommended approval of the variance to permit the second story expansion <br />based on the fact the building was constructed in iis current location prior to the adoption of the zoning <br />ordinance and that there would be no further impact within the average lakeshore setback. The Planning <br />Commission recommended denial of the variances to permit the 14' by 8’ deck addition between the <br />walkway and garage. <br />Manley stated when the property was purchased by his brother, more hardcover existed than what is there <br />currently. Manley stated there is no deck or patio currently on the property, with a small walkway <br />existing between the garage and the house. Manley stated they would like to improve the appearance of <br />the property by constructing a deck to tie in with the walkway. Manley noted they <br />previously have reduced the hardcover by 491 square feet, with the proposed deck consisting of 112 <br />square feet. <br />Mayor Peterson inquired what the width of the walkway is. <br />PAGE?
